Rule 119
Procedures to be adopted by the investigating officer
: (1) According to sub-rule (2) of Rule 118, the investigating officer shall have the right to carry out investigation proceedings by adopting the following procedure:-
(a) To exercise powers similar to those of the court in the matter of taking statements, filing written evidence and issuing subpoenas in the name of witnesses, etc. (b) To hear the evidence in the case of accused armed police personnel,
(c) To give an opportunity to accused armed police personnel to cross-examine witnesses and file evidence against the prosecution. (2) After completing the investigation work as per sub-rule (1), the investigating officer shall submit a report to the officer authorized to order departmental punishment. In such a report, he has to file his judgment along with the reasons related to the departmental punishment as well as the actual evidence.
